TWS TERMS AND CONDITIONS:
These are our terms and conditions for WEBSITE DESIGN | WEBSITE REVAMP | ECOMMERCE | CMS SYSTEM | NEWSLETTER| SEO | SOCIAL MEDIA MARKETING |BRANDING- LOGO DESIGN | BROCHURE DESIGN | DIGITAL BOOK | CONTENT WRITEUP | FLYER DESIGN | HOSTING- DOMAIN REGISTRATION | WEBSITE HOSTING | EMAIL HOSTING| and applies to all contracts, Invoice and all work undertaken by TWS DIGITAL.
PAYMENTS AND DEPOSITS:
At TWS Digital we charge 50% of the total amount immediately upon your confirmation and signing the contract for us to commence the project chosen by you. The remaining 50% shall become due when the work is completed to your reasonable satisfaction but subject to the terms of the “approval of work” and “rejected work” clauses. We reserve the right not to commence any work until the deposit has been paid in full.
The 50% deposit is only refundable if we have not fulfilled our obligations to deliver the work required under the agreement. The deposit is not refundable if the development work has been started and you terminate the contract through no fault of ours.
The Unlimited services is applicable only after the remaining due 50% is paid.
In case you are not hosting the website with TWS and your current hosting service provider does support the format, there will be additional charge for A Name Web hosting.
The leads provided or sold may not be rented, lease, sublicense or transfer the information or any data to anyone else. You may not develop commercial sale of any data in any form that incorporates using our provided information.
We guarantee 90% deliverability of the business list, email appending service provided with the agreement. There will be 60% accuracy on our stand alone business list.
It is your responsibility to understand and comply with all federal, state, and local laws, rules, and regulations including do not call and do not fax regulations.
You agree that the CLIENT Records, the Email addresses, the Matched Records and all other information will remain confidential and will not be resold to anyone.
You will have 30 days after purchasing the business leads to inspect and notify TWS of any operational problems or material mistakes with regards to the business leads. If any problem has incurred and accepted internally TWS will correct the problem and provide additional records if needed relating to the materially mistaken leads provided.
You will have to pay TWS prior to purchase of the list full or 50% of the payment.
You must supply all materials and information required by us to complete the work in accordance with any agreed specification. Such materials may include, but are not limited to, photographs, written copy, logos and other printed material. Where there is any delay in supplying these materials to us which leads to a delay in the completion of work, we have the right to extend any previously agreed deadlines by a reasonable amount.
Where you fail to supply materials, and that prevents the progress of the work, we have the right to invoice you for any part or parts of the work already completed.
We are pleased to offer you the opportunity to make revisions to the design. However, we have the right to limit the number of design proposals to a reasonable amount and may charge for additional designs if you make a change to the original design specification.
Our website development phase is flexible and allows certain variations to the original specification. However any major deviation from the specification will be charged at the rate of minimum $250.00.
Project Delivery time-frame:
Any time frames or estimates that we give are contingent upon your full co-operation and complete and final content in photography for the work pages. During development there is a certain amount of feedback required in order to progress to subsequent phases. It is required that a single point of contact be appointed from your side and be made available on a daily basis in order to expedite the feedback process.
Project Approval and commencing:
We will send you the home page design for your approval, you must notify in writing to us if it is satisfactory or need more changes to customize it to your requirement.
We need a minimum of 60-90 days to show you the results after making the 50% Payment as mentioned in Payments and deposits. The 50% deposit is not refundable in case you decide to discontinue our service in the given time frame. We do not do SEO project for monthly basis.
On completion of the work you will be notified and have the opportunity to review it. You must notify us in writing of any unsatisfactory points within 7 days of such notification. Any of the work which has not been reported in writing to us as unsatisfactory within the 7-day review period will be deemed to have been approved. Once approved, or deemed approved, work cannot subsequently be rejected and the contract will be deemed to have been completed and the 50% balance of the project price will become due.
